Hi, this is my first time in the forum and I wish to seek advice on my situation.
I'm a green card holder (singapore citizen) who got married while being a US PR. I wish to apply for my wife (singapore citizen) a green card.
How long is the typical wait? while applying, is it true that my wife can't enter the US?
I kind of know the answers but would like to confirm with this forum. I know the situation can be pretty bleak.

You have some good pictures, but I agree you would more easily get responses here if you include pictures in your post. One critique I can give is you should watch the level of your horizons, it's a pet pieve of mine as some here know :), I'm sensitive to leaning pictures.

As long as you have your returning documents, i.e. AP for yourself and valid unexpired visa for your wife you should be OK.
Just use AVR (search online and print the rules). This way you can return on same I-94 within next 30 days.
We used it when we did our landing back in 2008.

My wife and I will be Canadian Permanent Residents in a few months. I am on EAD with I485 pending and have AP. She is on H1B
We will need to Travel to Canada for Immigrant Landing formalities after we get PR.
How can we enter back in US so that my AOS and her H1B Status is not affected?

I worked under H1B (valid 11/02/2009 - 10/14/2012) with nonstop paystubs since 11/02/2009.
On 08/02/2010, some bad girl just wrote one short sentence false statement to USCIS and cancelled/revoked my H1B on 08/09/2010 secretly since she didn't notify anybody about what she had done. She also ignored 2 USCIS letters (dated 08/13/2010 and 02/04/2011 respectively) regarding the H1B cancellation.
When I was going to join a new employer in March, I was told that my H1B was "inactive" and "retracted" by USCIS. the bad girl subsiquently filed a H1B petition with nunc pro tunc requirement for me but USCIS only approved I-797B with validation period 04/14/2011 - 10/14/2012 without I-94. I have to get H-1B visa from a US consulate.
Will I be subject to 3 years ban?! Technically I have been OOS since 08/09/2010, however, I have been paid without any gap since 08/09/2010. I have nonstop paystubs since 11/02/2009. I am still being paid. The next paystub will be available on next Friday.
Will I be subject to 3 years ban?! Can I apply for a visa back?! Can I file a criminal charge against this bad girl?!
I feel hopeless until found this forum! Thanks for your helps!!!

Hello,
You can not (lawfully) re-enter on an H1B, as you're out of status. If you get caught lying at the border, you will be turned back and will likely be permanently barred from entering the U.S. You'll want to re-enter on an H4 visa - you dont need an H4 petition, although obviously you'll need to qualify for the H4, so be prepared to document your spouse's H1 approval and valid status.
Are you stating that you were laid off (thus overstaying), or that you were benched without pay (meaning your employer should have been paying you)? With more than 90 days out-of-status, you may have triggered a period of ineligibility to re-enter the U.S.
Given the apparent overstay issue, I suggest consulting an immigration lawyer.

With respect to your first query, as an applicant for AOS you will retain legal immigration status even if you engage in non-H-1B employment using an EAD. You will, however, lose "lawful non-immigrant (H-1B) status" if you perform work for any entity that has not petitioned for H-1B status on your behalf.
Keep in mind that merely applying for and obtaining an EAD has NO impact on your lawful H-1B status. So, given life's uncertainties, it's generally a good idea to obtain EAD and Advance Parole just in case H-1B employment is lost.

can you reword the title? I am not sure how that title is accurate given the background of how macaca was used: Sidharth (who was born and raised in the US, but is of of Indian origin) was called Macaca by George Allen because of the color of his skin. Getting a GC or not getting a GC does not change the color of one's skin so it does not stop people from calling you a macaca...
