Greeting everybody: I have been working for the same Company since 2002 first J1 then 6 years of H1-B expiring on July of this year (2009). Currently my employer is going thru the process for a Green Card with our Legal Firm and they proposed me an E Visa while the Green Card approval process is work in progress (I passed the DOL approval and I'm in the middle of the recruiting phase). I'd like to get a third party opinion if I can be granted a Green Card switching from H1-B to E Visa.
Anyone familiar with this matter?

My LCA for H1B extn for 6 years is approved on July 15. But still my company lawyer is not ready to file the extn. He keeps on saying that I didn't get the approval notice from DOL, It's certified online only, So without physical approval document, I cannot proceed.
Guys, Since it's certified already, Can he get a LCA detail and print using his account from iCert?
I also checked the online status in iCert (he gave me the case No), the status says certified.
So in this How long DOL took to send the physical copy of LCA?
Since my H1B is expiring October, I need to file extn ASAP. My company lawyer is not helpful ...

H1B, Perm/I140 are all employer driven. You are a mere spectator in this whole process.

I am not sure I understand why would you want to do this? You are on EAD, correct? This already gives you the right to work for any employer; getting an H-1B would be a step back in this regard. Am I missing something?
I am interested in changing from I-485 EAD to H1B. My reason being I want to change my work and get a different position. does anyone know what is the procedure?

Howdy,
You cannot file for EAD or AP unless your get your I-485 receipt (A copy of the receipt notice needs to be included in the EAD and AP application). The EAD and AP should go to the same service center as your I-485 application. The address will be listed on your I-485 receipt notice. Pretty straight forward, you can do it yourself, do not pay a lawyer for preparing these documents. Good luck.

I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

I have got exactly the same RFE.....i am going to send the same documents and hoping that this is enough. There was one question that was bothering me on my i485RFE. It started like this...............
Your FORM I485 Application Must be accompanied with two colored Photographs.................
I am confused if they mean that i should re submit the i485 application or just the letter taht came with it.
i also never got any colored sheet as i have heard most of the people got. Is this normal practise or something i should be conserned about

what about the july 07 fiasco filers..i know GC will only be given when visa numbers are available but atleast if 485 is approved we know we are half way thru...no matter the files will be licking the dust for years..gurus please share.

I do not get my pay checks by email. We have to log into our company's internal web site and take a print out of the paycheck. (Its actually a web page I have been taking a printout, even for my Visa extensions). My parents had a Visa Stamping last month with out any issues.

I know this is Off Topic (OT), but I was wondering if ALL Tax payers including immigrants on H1B will be getting the proposed tax rebates. This had happened in 2001 as well and my citizen co-workers remember getting checks.
Does anyone who was on an H1B in 2001 remember getting a similar rebate check? I definitely dont remember getting one.

I have recently moved from Company A(where I worked for 6 years of which last 4 years was in US on H1B) to Company B(working here for 6 months). My H1B transfer is complete but my VISA needs stamping. I need to travel to UK for 2-3 days next week.
Am I eligible to get the Visa stamping done in London? If so, is this a high risk option? How do you compare the risk of the option with the risk of alternate in making a trip to India from UK to get my Visa stamped? Does the fact that my current job is with a smaller(200 to 500 employees) IT consulting firm add to the risk significantly?
Do you think it is possible to get stamping dates around Dec 12-13?
In case VISA gets rejected in UK, what are the chances I can go back to India and get it stamped after that? And how long will that take on average?
