I dont think you will need them . I am also filing premium 140 and lawyer has nOT asked for all I94s ..ONly the recent one..Dont worry much if you dont have all of them

You want him to work with GC or just want to keep him working. ?
Eventhough the GC application is denied for EB1, you can process EB2 or keep him O-1 or H1B. For EB1, there will be strict rules by USCIS. If your company didn't meet the criteria for it, forget about it. Do it in EB2.
We hired a scientist with O-1 visa two year ago (company provided all the documents). This scientist applied green card (EB-1) last year. This week he recived a letter rejecting his application. The reason is not about his personal qualification but is about the company. Letter says company had no publications although we provided the copies of US patent applications.
We are a small R&D company with no budget for and work plan for any kind paper writing. Can INS use "without publication" as the only reason to turn down the EB-1 type application?
This scientist is very important to our company. What shoul we do to let INS reconsider this decision?

One of the reason may be L1 is misused very badly by body shoppers from all over the world.. example software companies ..
In case the person dont get H1B they will apply on L1 and get the green card fast, and also some guys come here on visit visa B1 Visa.
Meanwhlle genuine people here waitng for more than 10 years under Employment Based category.

Gurus Need Help.
We filed for I-485 on july 3rd..and got receipt numbers after calling USCIS for 3 of us.Yesterday we got receipt notices for me and my wife..but for my son we haven't received the notice when i checked the status online..it says case is rejected and here is the text message from the online..,
"On October 10, 2007, we determined that this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case"
Is any one with the similar situation? Please help what could be the reason??
and how long it will take to receive the rejected notice?

go_getter007: Your Last Updated Date (LUD) will change whenever they touch your file, which means a person has touched your file or an auto touch (soft touch , no case status change in case of soft touch). As of now, Online system is not perfectly synced with actual case status system. Hope this helps.

If you ever had an OPT EAD card, put that.

as far I know if the original/extension petition has expired then it is a case for new H1 ... hope others can confirm this ..

My salary in 2011 has been raised by $20K per annum, from what it was in 2010.
Will this have any consequences on my next H-1B renewal OR if i go for visa stamping OR on the PERM application?
Mine is a small company with just 12 employees and I hold the same position as I used to when i sarted. I just want to know if there would be any issues with this on any stages.
Your replies would be appreciated.
It's no problem at all if you make exactly the same amount as mentioned on your H1B petition or if you make more than that. It never is an issue to make more $$$$$$. Make hay while the sun shines.:D

If one applied for his I-485 before the H-4 visa was expired, then not a problem. The minor could obtain a new h-4 visa stamp overseas. He / she should take AP with her / him just in case they can't issue a visa for any reason.
Generally speaking, one who has a pending form I-485 is not obligated by law to maintain any other status such as H-1 or H-4 and the time after the expiration of such a status is not counted as unlawful presence as long as the pending i-485 is not denied.

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...

I was working with employer -A till 2006 and got I140 approved (Feb 2006) in EB3. In November 2006 I joined employer B as it is good for my carrier. I talk to employer A (body shopper) and he is ready to support for my green card as I worked for him for six long years and still he did not cancel my old H1B.
1. I have two options here my old employer (A) is body-shopper. So he will agree for both future or current employment. I have very good permanent job and bright future prospects with new employer (B). In this case what you guys advice me? Apply I485 as future employment or quit present job and join old employer (A) and apply I485 as current employment?
2. If I do not join old employer (with whom I have I140 approved) now, in this case what are my options for I485 applying? (Only future employment I485/ I can file current employment I485 and not drawing any salary from old employer )
3. Will I485 as future employment has any problems?

I was thinking I'm the only one waiting for the inventory data eagerly.I just stopped short of opening a thread though:)
As ridiculous and pathetic as it may sound in our case, Homo sapiens like to wait for something good or in 'hope' for the good to come.
While waiting for GC eternally, we learned to wait for VB each month,Demand Data used for VB each month,Inventory Data released quarterly. Of course, for all the analysis & comments that come out of each of these data points.
If it helps any, don't expect it before Tuesday/Wednesday next week.
Have a wonderful long weekend y'all!

Note to USCIS: don't delay your release dates of inventories. Keep us busy ...
