To the best of my knowledge - she will be in status as long as her H4 application is pending or even AOS pending and also her post OPT is 60 days as mentioned earlier..
My wife's H4 is pending. I applied AOS for both of US. Her OPT expired on 7/11. How long can she be in status until she gets H4?pls advise me!!!!!!!!!

If you have contacts in Cisco, Intel etc in bay area , can you please spread the word so morepeople turn out. I am about 8 hours drive form San Jose. will try to make it. This is awesome. We need to get as many people as possible on war footing.
Maybe no banners or signs because this is a town-hall style meeting and not a rally. I'll let you know if its ok to do that.
But surely, it would be good if you bring a sign/banner saying "www.immigrationvoice.org" which would help us get more coverage is its caught by the media.

So you gave up H1B and moved onto EAD? Is it because the new employer is not interested in H1B transfer or some other reason?
Also, my I140 was approved in 2006 and I1485 filed in July last year (both with a large, well-known company). If I change employers now and work using EAD, are there any major issues that can arise? Like furnishing of audit reports, etc?
I tried to keep H1 but finally I had to gave it up as "For critical positions we hire EAD/GC holders- US Citizens only and thus we can not allow H1 transfer for this position".

Large companies - So must be having 3 years Audit reports - perhaps available publicly (In my case that is the case -- so virtually no risk).If you get new job offer letter with "Same job description" as one under which your gC filed - no problem - No gap in pay stubs .. Thats a new trend. They go to colleges and meet a group of Indian students who are about to graduate and take them out of drinks and dinner and give a presentation about their company. Then when these students come into OPT status, they are all given food + guest house accomodation. Then they are put under intense training for 2 to 3 months and made to do some mockup projects. Then their resumes are massaged with 4 to 5 years of experience ie experience from date they graduated in the under graduation and their MS education is stripped off on their resumes.
This seems to be a trend, though the practice seems not too good. As most immigrant students are hard working and determined, they put additional hours and make up for experience and perform well at clients. They get a decent 65K to start with from the consulting company and their h1bs are filed well before the cap ends.
Can you please share with me PM some of these companies as I am lookin for a h1b sponsorer for someone i know who has done masters here.... and is fresher... not that he wants to put fake.... he is ready to get a entry level salary and state that he graduated out of school and is a fresher..... just that he wants someone to do his h1b...

I don't understand the IO calling Client part. What if (like most of us do) the person was traveling on a weekend? Is the client supposed to be on call for the IO?Besides, even if it is so, answering NO to that question implies fraud on behalf of the Client too.
I know a person who was sent back; IO called the end client to verify his employment and asked if they could hire american worker instead, when the employer said they could, IO sent him back. I think they are only going after H1's working for smaller consulting companies.
You may write it off as a rumor, so be it, but IV needs to step in and take necessary action.

It is just not desi compaanies, but small companies in general want to save every peenny and would like to extract more work and would not mind about ur status or legality but will just get their work done.
When you join desi company you have to deal with crap. Must be very careful while inbetween projects and make sure u don't accrue any bench time.

In my Opinion all non-immigrant s require to get the comprehensive conclusion on the STRIVE Act first before going through.
STRIVE Act is to reform the deficiencies in current Immigration policies so that it streamlines the immigration process and makes easy for the immigrants to join their families and also make the kids of non-immigrants who were bought to this country of not their knowledge/ choice able to work �
If the immigration process is proper there is no requirement for the people to come here and work illegally. Under new work process this illegal immigration can be resolved is the Point brought through these STRIVE Act.
Some of IV members getting to these meetings and keep saying I am legal and not able to get visa because there is no visa numbers available. It directly implicates that if there are Visa numbers available we are not here to support this.
In reality that is true if you happen to see the people who already went through the process, they always say/wonder why they are making the process so simple. In some occasions when the Labor certification process is made premium processing the questions/comments raised by GC holders is, why they are making this process so simple/ OO they are giving the LC just like that etc. once the GC is in hand no one will talk about anything.
Off these so called 12 million Illegal people can make the country aware of these problems in one moment and they can make the country stand still by calling a day or more off the work. In other hand, we so called high skilled immigrants (prefer calling high labor) they never, able to make this aware off. Not able to call a single day off the work. Even if they do they will make sure that nothing feels the absence giving automate script etc. Under legal doing illegal work is this high labor. Take consensus and you will find at least higher percentage will say they are always work more than 40 hrs a week. Which does legally illegal work? In other hand illegal but doing legal work in this country is the illegal immigrants they work for by hour and if they work an hour extra they collect for that also.
We always want the process from higher level, want to meet Law makers and want them to reform and understand the issue. But always forget the basic the Law makers are made by people. Did we had a chance to make the people understand this? Higher percentage of companies in this country employ immigrants and leaving the few exceptional company at most 10% of the work force in average is immigrants. Possible meet your company top level people and make them aware of. Among these there will be lot of people kids, nieces, nephews, brothers, sisters, spouses, friends of law makers who can chat with them without appointment. Of these there are many hidden people who can pull the strings in so many unknown ways. At that point you are not half million your strength is multiplied people are aware of this.
Of the all my request is please do not behave that Visa numbers are not available so I am here. Do not put the behavior before Gate Pass something and after the Pass what is this type.

That is because the quota system does not apply as well in the 4th quarter of each year. Thats the explanation previously given. EB India has to hope for the end of each fiscal year for some magic to happen.

Those EB India stuck in 485.................it is either now or next year summer. If you don't see yours by Sep't, unless you have a PD pre go into hibernation and wake up in June or July 2008, you might find better luck at that time.

average visa issued for EB1 ROW+Non ROW over the last 5 years have been 26K,
Now assuming this year the demand would be close to average then. It leaves 14K for EB2
Implying 12/2003 dates movement is very likely as 14k>5k (your number)

All , this subject has been raised very often and every time new members join in they start a thread and start questioning it.
- IV has indepth explored and studied this option and have found that this change is not possible administratively.
- we have not just met a lawyer. we have met few lawyers. we also have communicated with USCIS in the past.
- In the past some administrative changes have been done by USCIS, but this change cannot be done by them. All, we already had this idea long long ago and we also thought that why dont we do it if it so simple and then we dont have to go through all the legislative hurdles. But NO it cannot be done by USCIS.
- Faxing USCIS will not work. USCIS does not take policy decisions. We need to approach policy makers to get it done and that is what we are doing. By coming up with ideas, endlessly discussing despite explaination by IV and not working with IV action items we will all go in divergent directions and lose focus on the main action items we want each every member should focus. If you really feel for some idea and want to help, instead of asking IV to give explanation to every question on the forum, contact any of the active IV core members on the forum and bounce ideas. We need people with ideas and also same people willing to work on them too.
