Hope everything will turn out good for you. I don't know faith of our applications.
Im July 2nd filer application reached to NSC at 9.1 am and signed by R Mickle
Till date my checks have not been cashed. When I Called service center yesterday they gave me Receipt Number for I-485 (LINXXXXXX) but again she told me thats its Invalid then she put me on hold and checked something then see verified my address, Social security number also My Attorneys Name and address. After confirming this information she told me Receipt Number of I-485 is yours but its Void in our system let me check it online and online it shows case received and pending.
Now she said its weird its showing Valid in online system and in our internal system its Invalid. Then she asked me did you file 131 and 765 along with this I said yes then she said let me check it and found nothing.
She has created one service request for me and asked me to wait another 45 days.
Meanwhile I told this matter to my Attorney and he told me not getting receipt is normal and I could have asked you to wait till October 15th but you are there in the system and why they have stopped processing you applications looks strange to me also applications is not been rejected. So he told me that he will write letter to USCIS director to investigate this issue and assured me that as long as we are in their system so dont have to worry but he told me that if Director dont respond in one months time then we will go to court but he is optimistic that situation may not go to that.
If anyone of you in similar situation please let me know.

LC substitution was wrong because it became a business thing for some unscruplous employers who started to sell LCs and get people to work like slaves.
Bkarnik
LC substitution is not wrong if you look at what it was intended to do. Employment based greencard application is an employer's application and he has the right to give it to whomever he wants to.( especially when an employee leaves him)
The issue was that this provision was misused by many employers.

For transiting through US airports, you need to prove you do not have immigration intent or commitment to another country like home ownership, (and the whole nine yards that go with it). That is far more difficult to establish. Many businesses in developing countries that used to route travels to South America via Atlanta now route them via Europe which is easier compared to US since 2003.
Actually US travel industries are fighting hard to get Transit Without Visa (TWOV) and International-to-International (ITI) passenger programs in US airports re-introduced.

I am july 2nd filer, got my receipt numbers by calling USCIS. My data was entered in their system on Oct 5th. I called them today and the Immigration Official gave them. I also filed for my wife, but still her information is not yet there in the system. My application went to NSC, signed by R.Mickels at 9:01 AM, but transferred to TSC as my receipt number starts with SRC.
Good Luck to everybody else who yet to receive the receipts...

Very true. Another advantage is, Citizenship doesn't have any number limitations. It will also help people waiting for GC as the queue gets even shorter. Instead of making it 10 Years from first port of entry, if it can be made as 5 years from say Priority Date for Green Card, it will cover many more people. Technically the person expressed intent to live in US after accepting a perm job. It is admin processing and Visa number limitations that are preventing the person from becoming a perm resident. So the change be sold as proper interpretation of the law because of changes in the circumstances but not really opening a flood gate for citizenship.

One idea is to give GC to AOS applicants regardless of namecheck result, if all
other security checks are OK and let the namecheck run in background . If the namecheck turns out critical , cancel the GC & deport the applicant.
But USCIS and lawyers will loose big time , because of reduced demand for APs,EADs etc.

Can we remove the clause- 'Allow filing of Adjustment of Status (Form I-485) when a visa number is not available' from the letter. I think this statement is not as per Immigration and Nationality Act (INA).
Massive IV campaign for Administrative fixes
Dear Members,
Immigration Voice is starting a massive campaign to get administrative relief for our community. We have had several fruitful meeting with the administration in 2007, some of these meetings were scheduled in September, November and then in December. In these meetings, we were able to convince the administration about the implication and hardship due to current broken system. Since Congress has not been able to address our issues in 2006-07, we were successful in creating a case for administrative fixes that would give much needed interim relief to EB community. These meetings helped us start a conversation on possible administrative fixes like 3 year EAD-AP, clearly defining same or similar if AC-21 is invoked, and we are hearing favorable feedback.
Due to lack of action on legislative front our communitys patience is running out and we want some relief urgently to get out of probationary status. We are thus starting this nationwide campaign that will help our advocacy efforts and get administration to act quickly. There are several components to this campaign.
1) Support from lawmaker offices: We urge all our members to meet their lawmaker offices and get them to write to The President in support of administrative fixes and urging for an immediate administrative relief. The template of the letter is attached. Letters from lawmaker offices to administration get far more attention as compared to anybody else writing the same letter. The template of the letter is posted below. Please request lawmakers to give you a copy of the letter or lawmakers could copy IV on their letter to The President.
2) Support from employers: We urge all members to approach their employer and have them send a letter to The President expressing support for our administrative fixes and appealing for an immediate relief. The template of the letter is attached below. Please request your employer to give you copy iof the letter so that you could provide IV with the copy of the letter.
3) Plea from our community: We urge all our members to write personalized letters to The President directly and convey their plight. If you would like to write your own personalized letter, please do so with your own story. Make sure to stick to the administrative fixes we have listed in the letter template and how these fixes could help you and your family. Please put your name and address in your letter. Anonymous letters will not be delivered and will be discarded. We request that you create 2 copies of your letter. One copy should be posted to The President and the second copy should be sent to Immigration Voice mailbox address at
Immigration Voice
P O Box 1372
Arcadia, CA 91077-1372
The deadline for receiving all the letters is 9th February 2008. Our plan is to collect thousands of letters that we will also receive in IV mailbox and deliver them, along with the letters from employers and lawmakers across the country, during our meeting with the administration. We believe that this will make a necessary impact to strengthen our case and gather the necessary political will required for administrative fixes. We will also try to get media coverage for this campaign and draw national attention.
Please inform all your friends stuck in greencard retrogression and have them participate in this effort. Please post information about this campaign and link to this thread to as many sites, blogs you can so that we can get extraordinary scale of participation. The success of this effort will depend on the collective sincerity of the entire EB community to get letters from lawmakers, employers and members of the community. Immigration voice is counting on each and every member and it is in up to each member to make this campaign a success and help us to improve our and our families lives.

ok.. the letter is dated 4th august and did you get any information again that your case is assigned to a officer? if yes can you please tell how you contacted them? and after how many days?
I called the regular 1-800 number as soon as I got the response to the SR. Told the 1st Level that the statement in the response saying to wait till Visa is available seems to be wrong since the visas are currently available. The Level 1 agreed and transferred me to the Level 2. Level 2 confirmed that my case was assigned to IO on July 27. She said my case is probably delayed bcos of FP not being latest. Wonder if there is a way to trigger FP?

Congrads!
So when children reach 14 years of age they have to do fingerprinting?
That is true. USCIS will send you finger print notice when kids turn 14. They will print all the fingers (code3, I guess) at this time.

rsharma, l1fraud,
There is nothing wrong in reporting fraud.
However your argument that you are reporting it since you cannot tolerate fraud isn't that convincing.
If you were always against injustice/lawlessness, you will see a lot of it in your daily life. Do you report or take action against each of those ? I don't think so.
After living in India for long and seeing people put up with all injustice and sometimes doing it themselves, it is hard to believe your argument that you are doing it just for the sake of law.
I does not matter whether we are exposing L! fraud by these outsourcing companies for the love of law or pure selfishness. As long as there is a greater good out of one's intentions it does not matter what my intentions are.
I am an architect now and i know for sure that this profile is no longer immune to outsourcing. I am ok with that. I am reconciled with that fact and I am moving on to another field. However, my point is, if you want to outsource take the job to the low wage country. Do not bring low wages here. I am ok if outsourcing would increase because of the Grassley bill. I am not ok if the low wages are dumped in here. I hope you people see the difference.
My self interest in preventing this dumping of bodies is to ensure that this doesnt happen in the new field I am entering into. Remember, most aspects of manufacturing are outsourced to China. However, I do not see the chinese companies dumping in low wage manufacturing workers here.

Over the past couple of days I have had 10 of my friends/colleagues who have signed the letter and they have been mailed out to the president. I also have copies of them to mail out to IV once I have all that I can get..
I plan to call my Senators & Congressman's office's today too. I believe we need to get through to our friends and colleagues and talk about the issues in this letter. I have yet to come across one person who does not agree that our situation needs the attention of the administration.
I know I can get a few more of these letters signed by the end of this week.
Anyone out there who has more letters going out??:D
Lets have some healthy competition!

I recieved 2 notices in mail today.
One is the welcome notices which says that I-485 is approved.
Another notice which says that they reviewing or reconsidering the decision previously taken.
Called 1-800 # and the infopass. They say that reopened or reconsidering the case as the visa numbers retrogressed.
How can that be when am current in oct as well.
Mine is EB2 and the priority date is Dec 2004.
Any suggestions to have this fixed.
what is the dates of action on the notices? maybe that will clarify a little.

I agree to what you say. The intend of this thred is not to support/oppose the outsourcing/offshoring the jobs. The intent of this thred is the fradulent use of L1s by the offshoring companies.
If these companies play as per law then there is no issue. Everything is OK in moderation even outsourcing or offshoring. However these companies does fraudulent use of the L1s. They send endless people in L1s. Even if the person does not have hire/fire authority he/she is sent as L1A. General java/Oracle/.net developers are sent in L1A or L1B.
These people with L1s are placed at client location and they work under supervision of client manager. False names are shown in the chart under these L1As benefeciary when they are applied for renewals.
These things should be reported and should not be supported.
Falsifying information is not right. If you have credible information and knowledge - write about this in detail. Let people know, what's going on.

I have a question regarding this whole idea of filing on your own:
Whats the reason for doing this? Is it because:
1. Attorneys will be busy during this time
2. Employer will not file 485
3. Bad Experience with Attorneys
4. Anything else please explain
If 2, whats the guarantee that he will not cancel your LC/140 once he knows that you are filing on your own?
Sorry about bringing this up. My employer is ready to file 485 but not EAD and AP. He says if we don't renew our EADs on time then we will be out of status and hez seen lot of such cases. Can I file EAD and AP on my own and let my employer file 485?
Thank you all for the patience!!!

Can someone explain why it seems harder to find backers in the house than in the senate for immigration reform (even the employment based legal immigration)? If we understand this, maybe it will help us focus our lobbying efforts better. Just a thought.
arihant,
The constituency of a Senator is the entire state while that of a House Rep is usually much, much smaller. So the Senator needs to make sure that all his actions are more 'Inclusive' and do not offend a lot of people.
But since the House Rep has much fewer and probably much more homogeneous set of people, the needs of his/her constituents are not that diverse and hence they can afford to take a hardline stance in many cases.
