My reasoning for less than 3k visas for EB3 I
Assume EB3 I has 2800 available per year
2800/12 = 233.33 per month.
The spread sheet shows that there are 135 pending with PD of March 01 or less. Which is less than 233 the PD did not cross April because there are 452 applications in april. A PD of April makes sense. Using calculation the PD will be July 2001 in Dec.
if you assume 8080 visas per year then there will be 673 visas availble per month and the PD should have crossed to May 2001 because the total pending 485s on May 1st are 587. If we go with your assumption then the PD in December will be at Jan 2002...I
This is not the correct understanding. I know this myth is propogated millions of times in millions of board and so now this myth has become "truth" for millions. But that is not the correct way USCIS does things.
Country specific limit - 9% does NOT have any realtion to "assigning numbers". it is just meant to "approve 485 - mail you a real physical green card".
In ROW cataegory other countries are also bound with this 9 (7 + 2) % limit for Visa granting. For an example - For Pakistan USCIS will never grant more than 9% visa per year no matter how many applications from Pakistan have been assigned a valid visa number. Same will go true for Britain or any "other" country.
In reality How USCIS divide 28.6% among countires - That is unknown mystery and nobody surely know that. And that is why I had to assume "equal shares - 5 part" in my analysis assuming USCIS works fairly but we all know that is a bullshit too :)

If USCIS is providing spillover visas to EB2 in May, shouldn't the PDs of China and India (countries with most demand) have the same PDs in May VB? Doesn't this also mean that in the worst case the PD of EB2 India will be Jul 22 2006 (the current PD of China) in May VB?

I talked to my immigration about this today. My wife is on h4 and her h1-b is not selected in this year lottery process. I wanted her to go a school which issues CPT in less than one year so that she can start work. But my lawyer strongly recommended not to change her status from H4 to F1. My PD is 24 March 2005 EB2. Lawyer told me that it might cause a problem for my wife to get the GC on her I-485 application. Lawyer said some of her clients got through without a problem and some of her clients have problem regarding status change from h4 to f1. Fianlly i decided not to take that risk. I'm still waiting to file I-485.
My lawyer also strongly advised me against converting her H4 to F1. However since there was no visibility so I asked him what to do to get my wife working status. It was then he advised me that if she wants to start working badly then go ahead and apply for F1 but don't travel out of country while on F1.

How do you guys know that 12K visas will be allotted in one single month(May)? From USCIS point of view, won't it make sense to keep some numbers as reserve, if the EB1 picks up in the 2nd half?

Now, knowing USCIS uses outdated software, the question is are these people that are greened, taken out from the so called "queque" for EB3?. And then hopefully the line gets shorter for EB3s?.

DOS has publicly admitted that they made a mistake in the past interpretation and allowed visas to flow to EB3-ROW and EB3.
Do yo uguys seriously expect DOS to start making the same mistake they publicy apologized for a few months back?
We all talk about staying united.. but if EB3 folks are going to get together and start asking DOS to unfairly divert visa numbers away from EB3 (mostly to EB3-ROW... numbers will run out before EB3-Isees it), how are EB2 folks expected to just sit and watch?
How can we stay united then?
What would you do if your blood brother was in EB2 while you are in EB3? Would you do the same?

could you please guide us wheather we should send all the paper i.e. EAD + Ap to Nebraska address or EAD to Chicago address ?
my and my wife medical was done in august last year .. will that be valid , i have read somewhere that it is valid till 1 year .. is that true .
Is there any form for Finger printing ..

I would go for medical test again just because of PPD test. According my civil surgeons office, PPD test should be with in 6 month when u file 485 otherwise you may get rfe for fresh ppd. Seems these days CIS is very particular about TB test.

Looks like they do not publish the e-mail address to contact congressman. You can send e-mail only through contact your rep system where you can send only to your local rep. If your ZIP code does not match the congressman's district, then you cannot send him the mail. Even to Judiciary committee chairman !!!!!!!!!!!
The only alternative is to send fax. I don't know how I can send so many faxes when I don't have fax at my home.

I-693, supplemental I-693 (vaccination record) , copy of enclosed documents, blood tests (HIV) , skin test results( BCG), your acceptance for these tests, x-ray report (if skin test is very positive - see belwo) and TB diagnosis ( no TB) is enclosed in the sealed envelope. In original.
The same set is given to you. The medical staff with go through section by section and show it to you (in your copy) that all sections are completed ans signed. If you take vaccination on the first day, then on the third day they will give you sealed cover. [LIST=1]
