I have copies of all I-94 and I-797 but still my attorney thinks that it is not necessary to include them. My attorney also not including any w2s/tax transcript/tax returns/pay stubs. She said, her office filed so many 485s without above documents and never had any issue. Their opinion is to supply just what is needed not more not less. But my other friend's lawyer asked w2s and paystub.

The theme of �Lage Raho Munna Bhai� centers on the usage of non-violent principles to win over difficult and non-co-operating entities. In the movies, character Munna Bhai wins over the tough Dr. Asthana by means of chain deliveries of flower bouquets. The sequel has revived Gandhian principles and popularized the concept of Gandhigiri- literally meaning a symbolic act of peaceful protest across South Asia and the UK.
Rajkumar Hirani, who has directed the Munna Bhai series, had this to say - "When you feel you have been wronged, you feel angry. The best way to overcome what you think is unjust, is to protest peacefully. Be nice to your opponent and let him see your point of view. Some applicants or their representatives even traveled personally to Immigration Service Centers to be the first ones to submit. I am not saying that we are reporting fraud just for the sake of not tolerating it. This is effecting our GC. Earlier the effect was related to the job being taken away now it is effecting our GC too.
Initially L1s were sponsored only by large offshore companies like TCS, WIPRO etc.. The effect was that the jobs were taken away. But it did not have much effect on the GC side as most of these large offshore companies do not process GC for their employees.
But nowadays lots of small Offshore companies started doing L1As. These companies do not have lots of clients like TCS or WIPRo but they have a handfull of clients. So to make sure they have their clients they started bringing people in L1As and processing GC under EB1 for them. Although many of these people are developers and should be in EB3 and should be behind in the line. But as they are in L1A and are appling in Eb1 they are getting GC in no time and also taking the visa#s away. There are hunderes of these small offshore companies started getting people in L1As. Thus these EB1 Visa #s are not overflowing to EB2. This is effecting our GC.
Now we have :
1. Large offshore companies sponsored L1s taking the jobs
2. The small offshore companies sponsored L1s taking the GC visa #s.
If the L1As are indeed senior Manager then no problem, but the Developers/Business Analyst/ Project Manager without hire-fire authority are getting GC under EB1.
Thus these frauds should be reported so that at least the # of EB1 visas are not taken by fraud.
So you too can see how this fraud is effecting us all.
Do you know why we are having GC delays ?
1. Country cap for visa numbers
2. Visa numbers wasted by USCIS by their inefficiency
EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.
If you want your GC faster, work with IV for country cap removal and recapture.
Have you donated a single dime for IV's cause ?
We always find it easy to go against fellow immigrants than fighting the injustice at root.

I called FBI yesterday and asked for FP results. I was told they sent it to uscis and I saw LUD. Question is:
1) Does finger-printing & name check go together?
2) When FBI sends it to uscis does it mean nc/fp cleared?.
Any thoughts on this?

One of my friend (H1b) got into a job ( after passing labor market test - LCA - that no USC/GC could be found). in fortune 500 as direct employee after the job was vacant for more than a year.
However the same job was sent offshore after 8 months his tenure in that job. He was ok as he retained shares, signon bonus and severance.
All we see here is Indians competing against Indians in one form or other.
This is not affecting USC/GC.
How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.
Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.

My immigration doctor told me that if i had chickenpox in childhood i do not need the varicella vaccine? Which i did at age 5. Please, let me know if anyone else was told the same , i will be going back to him on Wednesday for the physical exam. I don't want to get a RFE on that.
If you had chickenpox in childhood, you have to show a letter. you no need to take varicella Vaccine. But my situation I had chikenpox in childhood, when i went to immigraiton doctor , i dint tell that i had chickenpox in childhood. Doctor told me to take Varicella Vaccine. I took that one.

Answering my own question. According to my lawyer if I use EAD, I can not use H1/H4 stamp in the passport for travel as it is no longer valid.

I also have the same question as bindas74. We both have our H1 stamped till July 2009, only my son does not have it stamped.
So if we don't apply for AP now and start using EAD and then travel outside of US can I still come back on my stamped H1 visa?
Any help appreciated.

I am also in the same boat.mine interview was also on 11th feb in mumbai and VO told me that she is not able to verify my data in the system.she told me I have to look for an email which I will receive in 5-7 days and she returned my pp, env, 221(g) letter and also wrote PIMS on my DS 156 form. she asked me now not to come again to consulate as everything is done once I receive that email just submit PP, envelope, 221(g) form , email to VFS and they will get my visa stamped in 2-3 business days.just keeping looking for the email she said two three times.Also "Not in" is written on my envlopes.
Let me know once you receive an email , i will also update once i receive the same.Good Luck!!!

I am all for it, and would support it in whatever way possible. Although not sure how it would work. It would require a gigantic change in the US laws.
I am here for past 11 years paying all possible taxes. Fortunately i was able to file 485 in 07, thru my second gc filing. Bought a house in '06 in a bold move, with the hope that gc would come thru sooner or later. Overall happy with the move to my own house (though the house value has dropped considerably since). Waiting is really painful, but I'll continue to maintain a positive outlook till then.

USCIS has become efficient, by this time all (or most) of the EB2-I visa might have gone. I am wondering any 2005 approvals?

Hi Guys,
I am pretty new to the forum (as a member), I have been browsing the same for quite some time and found it a good source of information regarding immigration related activities. Right now I am getting removed from my project as one of the top 3 Indian outsourcing firm is dumping their L1 resources at my client site and replacing all the citizens, GCs, EADs, H1 etc. These resources are used in projects managed and controlled by my client (most of them are consulting assignments) and these resources are used on java/.net/oracle projects, these two are violations of L1 visa restrictions set by USCIS, I want to know how and where to complain against this violation and we have all evidence to prove the same (project documents, time sheets, work assignments etc). Please let me know exactly and to which agencies we should complain.
