its ok, you misunderstood my point. I dont want to divert OP of this thread.
Anyways the fact of the matter is that we are in a limbo, all indications point to Obama becoming the next president of US. if CIR 2008 was any indication , we as EB applicants are royally screwed if Sen Durbin dictates his immigration policy. What is the use of talking about wars and innocent people when chances are that the advocate of his immigration policy is opposed to my main issue of EB reform. high low Taxes, 401k's, houses, Medicare etc will matter if you get to stay here in the first place. A average 6-9 years of paying taxes, supporting medicare and Social Security and we now need to think about moving to different countries where skilled immigrants are welcome....think about it. Just look at the CIR 2008 discussion to understand what i am talking about. Read the senators transcripts.

Came to US in 1999
Applied for EB3 labor in July 2004
Applied 485 in July 2nd 2007
Waiting for EB3 dates for India
Mean time wife applied for EB2 NIW Self petition in March 2006 and got approved
Again she applied for new labor in Nov 2009 and applied for I-140 in May 2010 in EB2

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. Now stop making fools of yourself and get a life.

Based on the criteria above I dont see how it is illegal to ask what type of work authorization one has, and if EAD , how long it is valid. It may be illegal to disqualify a candidate who has EAD with validity for the required amount of time. But I sure can ask about the details within legal limits, can't I?

It is illegal... On I-9 it clearly says that an employer can not deny employment because of an expiry date on a valid work authorization document. This makes sense, since the employer does not have any authority to check for this candidate's ability to renew the authorization, neither the candidate is obligated to share that information. Per DHS & DOL once you have valid EAD, you are good to go! I am curious though who should be responsible for educating these employers!:confused:
Good to know. As to who should be responsible to educate the employers....there's no doubt in my mind ! It should be us - prospective employees - applying for job. If we don't raise the issue, then who else will do it for us !!!
People can follow a polite plan of action for such questions...
- Be aware of the law
- Be prepared to respond back politely - giving the bare minimum info that would be sufficient
- Point politely to the law during interviews if pressed hard to divulge details.
- If you see the interview going no where, without having to divulge the details, then at that point its a matter of consience....If you had EAD with enough validity, and you think/guess, that the employer is only concerned with people with soon expiring EADs, and if you want the job bad, then may be you can give it a shot and divulge your details. But as much as possible one should shirk the issue politely until you pass the interview process and they are ready to hire... Divulging at that point is beneficial since you know if you get rejected at the point, it was purely because of EAD issue and can take them for a task. If you divulged too early then they could hide behind other reasons for not hiring you.....(unless the employer is CapitolOne, and the HR guy sends out an email blatantly providing proof of discrimination and leaving themselves at your mercy to be sued :) )

Most people can't even differentiate between what is law and what is not. What are difficult things to accomplish and what are not.
It is absolutely imperative that 5882 pass otherwise the situation will continue to exist.
Here are the my estimated waits for EB3-I
PD(end of the calendar year) and its corresponding wait in years
2001 1 year
2002 3 years
2003 4 years (Bad economy in 2002 and early 2003)
2004 7 years (Case surge in 2003 and 2004 due to booming economy)
2005 8 years (fewer cases in 2005 due to PERM)
2006 10 years
2007 12 years
2008 .....

No need to worry.
People write letters all the time to the president and first lady, FBI, USCIS, etc etc when they are stuck in namechecks.
The thing is why should be force ourselves to write letters when we are in deep sh** like namechecks ourselves.
Why can't we do it when we can do it as a large group of people and not being selfish for once. I think this is our chance to stop being a lone voice when nobody hears us. In this campaign we can show how important our issue is and how desperately we want it to be fixed.
BTW I am going to post a handwritten letter. I have heard it works better.

I have sent the letters today to WH and IV.
I have also sent group emails to my batchmates from my engg college asking them to join IV. I think everyone should do that - this will help IV to Increase its Memberships.
I had one more suggestion too - (this has recd less support in the past).
we need to put in a statement that many legals are not buying a house because of the uncertainity in the GC process. even the congressmen will be more patient with our cause when we mention housing.

You will be considered a PR the day your I-485 was approved. In my case, I am not sure where they got the 2008 date. Most likely it is a data entry error.
Based on my conversation with USCIS customer service, when I return to US, at POE the officer will definitely notice the discrepancy that my I-485 was approved on 09/20 but the card says something else. This might lead to further questions... Better to avoid all this and get it corrected.
It could also lead to issues during citizenship as I am aware of the error. Best is to get a replacement card with correct details. It is surely a hassle considering the 3-4 months wait time, but the right thing to do.

e.g. donors get access to all threads, contributors specific threads for which they have contributed and freeloaders general threads only. i guess that means setting up contributions at the thread level - not sure if thats possible right now.

I think the division of Eb2 and EB3 will be over when oct VB comes. Mostly Eb3 will go back 2003 or 2004 and Eb3 date may be 2002. At that time there will be unity.
