    Oh's website is like a thanks giving store sale. Stores advertise super duper low prices for stuff and when you get there, they will just say that the item is sold out. They only keep handful in the inventory so the first few who camped out overnight will get it and rest will get frustration. The main idea is to bring people in the store so that they will buy other stuff while they are there.

    Oh also uses the same tactic. He just announces sensational news all the time so people keep visiting his web site and more often than not, he'll just go back and retract the statement. The idea is not to share the news but to keep the traffic coming on his website for spicy breaking news and some might end up becoming his client.

    I say the trick works. Even though I know that not everything he says can be trusted, I still visit his website to see if he has any new rumor. Go figure.

    You stand is understandable, but I still will urge you to join me. It is of course not illegal but unfair towards the people already in EB2 line. If there were no limits on visas, it will not have been an issue to begin with. Think about the depth of the issue.

    I am EB2 and have a Masters but I don't support your case or even the basis of it. Mostly it is because I don't think MOST of the folks who use PD porting are doing it illegally or even cutting through the line undeservedly. If I am not wrong, these folks will have put in the time (work exp wise and/or added higher education) and should rightfully get the position certified as EB2.

    Now granted that there are always a small minority people who genuinely are not deserving. First, can you define in your view what kind of PD porting is unethical?

    Additionally, can you back up your claims by providing any kind of stats of such cases per year and how much impact it really causes to the GC wait time of those already waiting in queue for EB2? Are they that significant for you and Rolling Stone to feel so wronged?

    In conclusion, unlike the unjust labor substitution process, your case is not convincing because I don't think most people availing PD porting are doing anything wrong legally and ethically. I would love to see stats and examples though.

    This prediction business is done just to derive satisfaction of doing something towards a goal. This is especially true when one can do very little to get to that goal and it all depends on many other factors. Yet predicting the PD is not a bad endeavor by itself. That being said, predicting PD is not an easy math without knowing the PD of the last pending application in a category with the CIS and many other numbers. If I am right, I believe even the DoS and CIS have trouble with it.

    This what one Mr. Oppenheim says, "This situation will allow me to advance the India EB-2 cut-off date for May". That is it. So the PD will move in May unlike in the past when it moved in June/July/August in a FY. My understanding at this point is that there is no way to predict what will happen to the PD in May VB. THere are just not enough precise numbers available to do that. The May VB may come on 8th April and the numbers that are accounted for in it might be as close as 1st April'11. We do not have that number with us.

    10 yrs, 2 labors, 2 I-140's, 2-485's, more than 10 infopass appointments, two senator requests, more than 8 level 2 SR's, email to SCOPSSCATA and NCSCFollowup.Nsc@dhs.gov and then finally got CPO mail as christmas 2010 gift.

    In my opinion the email helped move things lot FASTER. Took over 2.5 months after email to get the GC. I would like to thank all IV members for great insight and suggestions.

    What is the source for the number 218,000? Is this purely speculation or in some official reports? USCIS Ombudsman report, some official USCIS publication or from any other organization?

    Have there been reasons other than Pims for delays? I see a lot of 221g cases in the forums. Are these due to PIMS?



    I had my interview for H1-B (first stamping) at N. Delhi consulate on 5th December. I was given a pink 221(g) form, and it's been almost THREE MONTHS and I'm still waiting for my visa stamp. My lawyer contacted DOS and they said it was awaiting a "security clearance" and were not able to say anything about how much time it would take. Hope it helps.

    WiFi is 2.4 GHZ.

    5.8 GHZ phone will have many disadvantages.

    The BEST choice for cordless phone for range, and lack of interfearance is a DECT phone.. the 1.9Ghz range is a licenced radio frequency for the exclusive use of cordless phones, unlike any other cordless phone frequency (900Mhz, 2.4Ghz, 5.8Ghz.) and as it is lower in frequency (aside from 900 Mhz) it operates with the furthest distance than any cordless phone.

    Aah - okay, I stand corrected. I did not know DECT phones run on 1.9 GHz.

    Anyway - both the links I provided are DECT phones. So they should still be good if you are in the market for a phone :-)...

    It happens to me too. Anything too good has always followed by something bad and vice-versa. I am just talking about the pattern. When my LC got approved, my spouse was severly ill and diagnozed with severe un-curable heart condition and is under expensive & tedious treatments now. We have to confront life as it comes and avoid making any hasty decisions based on the situation. That's the main reason, I am desparately waiting for GC, so that we could get better treatments, which I cannot even imagine to get in India.
    Anyhow, here is the letter I have drafted to Napolitino. However I would like to stress the point that USCIS has to approve the applications based on PD, but lost for words. (Thanks SoP for your idea of first few sentences in this letter)

    Dear Secretary Napolitano:
    I would like to bring to your attention that my Green Card process is unfairly getting delayed despite the fact that all checks and clearances were completed and my application was pre-adjudicated. Above all, visa number is available as well to approve my case.
    I, <name>, have filed for I-485 to adjust to permanent resident status on August 17, 2007, based on employment (EB2). My priority date is July 2004 and is current and my case is beyond the stated processing time.
    I took infopass appointments twice after our dates became current and raised Service Request 40 days ago. But no action has been taken in our case so far.
    I am really frustrated about the long wait, considering the fact that all checks were done and our cases have been pre-adjudicated. My frustration is not only because of the long wait, but the applications with Priority Dates later than our ours like December 2004 and January 2005 were approved. I am not sure of the pattern followed by USCIS.
    Senator's office is already following up with my case. But nothing seems to be moving.
    Ms. Napolitano, your action is urgently needed to approve my case as I have been waiting for more than 5 years for the green card and I am afraid that visa number may become unavailable soon.

    There has been some requests for the letter format that I sent to Napolitano and Mr. President. I can't put them in the public domain but I'll be happy to send them if you give your personal email ids.

    Yesterday was a very eventful day for me...in the afternoon my wife got approved and 12 hours later we had to call in emergency 911 to take her to the hospital as she was having such strong chills and violent shakings..we all got scared and we have a 2 and half month baby on top of that.....but with strong dose of antibiotics and drips she is better and back.....wow what a day and night.....

    In any case I'll answer all your queries....I feel the option 4 is the best way to get to TSC...I have always used that....congressman's office has discretionary powers and you should use that.....use strong words it is your right......they are here to serve you unlike in India where they are there to get pocket your money....no pun for my motherland but unfortunately it is true....

    Try a time frame of 4:30-5:30 EST to call the TSC or NSC for that matter...ppl are in a better mood at the end of the day and on thursdays and fridays.....ping your lawyer and ask him or her to intervene......if you know for sure your case is preadjudicated write it strongly in your mails to DHS and others.

    I had in fact attached the previous year letters and their responses back to me in my last mail to Napolitano and it was really quite strong.....I am sure it is hard not to take a note of it......I don't mince words and I believe that one should fight for one's rights....

    I have been associated with organizations like ASHA, AID and DISHA for long and that have taught me a lot too.............


    Again your attitude should be "You have nothing to loose"...so make a best case for yourself and go for it...

    I would like to think that by now DOS combined with CIS probably have a good estimate of the spillovers based on historical trends, current demand, pre-adjudicated cases, existing I-140's and porting cases. Assuming they have this data and the current availability of visas including spillover for 2011 as someone pointed out they might take the dates out towards 2008-2009 possibly since the CP cases are also coming to a close. Hence they could open a 2 year window so that the pipeline can move consistently instead of opening the pipeline by making EB2 India / China Current and flooding the system causing endless delays.
    I think most of us ignore the CP cases which DOS/ CIS has to ensure has a full workload possibly explaining the NVC updates of fee requests-

    I would bet that whatever they do they will work together with CIS is to ensure that workload with CIS and consulates all around the world is maintained and if anything a smooth consistent pipeline is also established for the future- this is just a guess- most of it is anyways.

    What I am suggesting is that the right time to take this up is when a recession is not in full swing. Between 2004 (when this law was enacted) and 2007 was a great time to pick this battle. Maybe another year down the line would also be a great time to pick it. Picking up this particular battle right now would probably make YOUR and MY lives much more difficult in the medium term.

    I disagree. By not reporting the fraud at workplace, it puts rest of workforce not at level playing field.

    Like you and the OP - I am a selfish individual. I will pick up only those fights which are in my interest. I believe that this particular fight is a lose-lose proposition in the current climate. I am disputing your (and OPs) belief that this will be beneficial for you/me/rest of us.

    Lets take the example of the same Goldman Sachs manager. Tomorrow ICE comes to him and says you need to get rid of these 50 guys under you. What will he do? He cant increase the budget in the current environment. So he probably will hire a couple of GC holders/Citizens and replaces the whole division (with 50 GC/Citizens besides the 50 'violators') with an offshore team.

    You are right. If you are not impacted by fraud, one will be least interested in reporting the fraud. Only when you get impacted, the fraud appears real and serious.

    To give you example, There are only 3 people on H-1B at my workplace and none on L1 visa status, so no one cares here about this issue.

    BTW - I am a US citizen of Indian origin.


    Think about it!!

    Now is the time when everybody is thinking in terms of cost cutting. If you create costly disruptions now - then either the company becomes GM and lose out to overseas competitors or migrates the entire division out.

    Taking your example further, due to budget constraints, the manager will be more inclined to replace workers to L1 workers to save cost. Do you want this? This will impact people in short term.

    Guys why dont you get it??? :mad::mad::mad::mad::mad::mad:

    EB1 is the most imp for US, followed by EB2, followed by EB3?

    Why should USCIS follow the approach of oldest priority first? without any regards to the EB categories?

    EB categories were created for a reason, doesn't matter how smart you are. If you are in lower skill category your wait is bound to be more. I don't see anything wrong in that.

    If EB1 is current and EB2 takes 4-5 years you can't just start crying. Similarly if EB2 takes 2 years and Eb3 takes 7-8 years you can't panic. Stop being a cry baby and start respecting the inter EB level priority.

    Factoryman,

    Apprecaite ur taking time and responding to my query. When I said add to mother's file I was quoting USCIS rep, earlier I was speaking to them and they mentioned something of that nature. I will call again tomorrow and speak with different rep to see what they say. I am the principal applicant in this case. If we could read and understand the AILA handbook none of us would need to go to an attorney for anything. I am here to get advise from people who may have already done it and learn from their experience. Once gain please share your experiences on this so others can benefit from it.

    As a US Educated Master and originally EB2 filer. I think this is one of the most stupid action ever within the EB community. So you think we are not weak enough and want to divide us more?
